The Suffolk County Family Court handles cases involving children and families. The Suffolk County Supreme Court handles divorce, separation and annulments. Cases that can be heard at the Suffolk County Family Court include: child custody and parenting time (visitation); child support; spousal support; paternity; orders or protection (family offenses); guardianship; adoption; juvenile delinquency; neglect, abuse, termination of parental rights, foster care placement; enforcement; and modifications. Suffolk County Family Court does have the power to handle post-divorce proceedings concerning child support, custody and visitation as long as jurisdiction was not reserved in the Supreme Court in the divorce papers.

We handle cases all around the Long Island and New York City area, and are familiar with most of the practices and courtrooms in both the Suffolk County Supreme Court and Family Court. In most cases, after a divorce has been issued, the Supreme Court or the Family Court would have concurrent jurisdiction to deal with future matters involving child custody, parenting time, maintenance and child support. In a matrimonial matter the venue choice can be made by the initiating party. Usually the initiating party will choose a county that one of the parties resides in. However, in matrimonial proceedings, a county that neither party resides can be selected for various reasons such as a faster turnaround time for filing to Judgment. So long as the venue is not disputed, the case can proceed in the desired county designated by the Plaintiff.
