Although we handle cases all around the Long Island and New York City area, currently our highest volume of casework is in the Nassau County Supreme Court and the Nassau County Family Court. Accordingly we are familiar with most of the practices and courtrooms in both of these locations as compared to other counties. In many cases there can be a choice as to whether to bring a case in the Family Court or Supreme Court and even which County in which to file the case. For example, most of the times, after a divorce, the Supreme Court or the Family Court would have concurrent jurisdiction to deal with future matters involving child custody and parenting time, maintenance and child support. There are nuances particular to each court which we can discuss with our clients. In a contested case, the initiating party may choose to file it in any County that one of the parties resides. Sometimes, the initiating party in a matrimonial proceeding may choose to file the case in a County in which neither party resides for various reasons such as the possibility of a faster turnaround time from filing to Judgment. If venue is not disputed then the case can proceed in the county designated by the Plaintiff.
